Costs and timing

The canonical process has times and costs quite different from those of the civil courts, which may vary according to the characteristics peculiar to the individual case, and depend in particular on the court in which they are held.

How much does the canonical process cost and last

he duration of a judgment is not always easy to predict; this is also the case in canonical proceedings. The duration depends on the nature of the case, the ease of finding evidence, the cooperation of the parties as well as the organizational needs of the court. It may be recalled, however, that the Canon Code stipulates that cases last one year, so this is what the Tribunals are aiming for.

The procedure for the declaration of nullity in the first instance in Italy involves a cost of € 525.00 for the contribution to be paid to the Tribunal in addition to the payment of one's lawyer's fee. The fee provided by the CEI for this type of case varies between € 1,600 and € 3,000 approximately. For the less affluent, there are forms of total or partial exemption of costs, but verification of the prerequisites is the responsibility of the individual court, so it is advisable to ask for specific information.

In contrast, with regard to the Tribunal of the Roman Rota, the one commonly referred to as the Sacred Rota, costs are different and vary depending on the type of case. As a mere indication, it can be said that the minimum costs amount to € 1,500.00 plus any expert fees and extras. In addition to this amount must be added the lawyer's fee, set between € 2,000.00 and € 4,000.00. However, this is without prejudice to the possibility of access to free legal aid under the established conditions. For more details on costs, however, it is advisable to contact the firm.
